Procedure for restoration of student rights

 

RESTORATION OF EDUCATIONAL RIGHTS OF A PERSON WHO HAS TERMINATED STUDIES IN EDUCATIONAL INSTITUTIONS IMPLEMENTING PREVIOUS PROFESSIONAL (ARTISTIC) AND MEDIUM PROFESSIONAL EDUCATIONAL PROGRAMS

 

Regulation for Restoring the Student Rights of a Person Who Has Left Unfinished Studies in Educational Institutions Implementing State and Accredited Non-State Vocational and Higher Educational Programs in the Republic of Armenia

This regulation (hereinafter referred to as the "Regulation") defines the procedure for restoring the student rights of individuals who have left unfinished studies in educational institutions (hereinafter referred to as "the Institution") that implement state and accredited non-state vocational and medium-level educational programs in the Republic of Armenia.

A student's studies are considered unfinished if the individual:

  1. Has been granted academic leave in accordance with the laws of the Republic of Armenia.
  2. Is on targeted leave as provided by this regulation.
  3. Has received a deferment under the Law on "Military Service and the Status of Military Servants" and been conscripted for compulsory military service.
  4. Has been expelled or dismissed from the Institution.
  5. Holds a diploma of incomplete medium-level vocational education from an institution not accredited by the state.

Following the decision on the reorganization or dissolution of the Institution, within 5 working days, the Institution must provide the student with a copy of the dismissal order, a copy of the contract signed with the institution, a certificate regarding tuition fees, an academic transcript, and the completed educational program’s final document, provided the student has met their contractual obligations (including tuition payments).

The Ministry of Education, Science, Culture, and Sports (hereinafter referred to as the "Ministry") confirms the list of institutions that can organize further studies for students within 5 working days after the decision on the reorganization or dissolution of the Institution comes into force.

After receiving the documents, the student must submit the documents required by the Ministry to an approved Institution, in the same or a related field, within no later than 5 working days to continue their studies.

The student may apply to another institution on the approved list within 5 working days if the student is not admitted or if the Institution’s director (rector) refuses admission based on the principles outlined in this regulation.

If the student fails to submit the documents to continue their studies by the deadlines stipulated in point 5 of this regulation, the organization of their education in the next academic year or semester will be regulated by the provisions of this regulation.

The director (rector) of the Institution must consider the application of the student to continue their studies within 5 working days after receiving it, following the requirements of this regulation, and decide on their admission (according to the student's preferred form of study – full-time or part-time) or refuse admission.

If a student has been dismissed or expelled from the institution, their tuition fee cannot exceed the tuition fee at the previous institution. In the case of a paid education system, the student's enrollment is carried out only after the relevant payment has been made according to the terms set out in the contract.

A student who was receiving a full reimbursement of tuition fees before the reorganization or dissolution of the Institution can continue their education at another institution, keeping the same rights, based on a request to the new Institution.

Graduates with an unaccredited medium-level vocational education diploma may restore their student rights if they do not have 3 years of work experience in the relevant field from the last 10 years, or if they lack 1 year of work experience within the last 3 years.

The graduate can change their field of study while keeping the principles and requirements outlined in this regulation, provided they continue their studies in the preferred field for at least one academic year.
